AMCJAX, I don't look at the ITC as the 'real' courts. Yes,
it has a lot of power, BUT it still answers to the federal
appellate judiciary. It answers to an Article III court (third
article in the US Constitution), which is the CAFC.
If we lose the CAFC (or any circuit court of appeals), we're
screwed. And I truly mean that.
I have some experience with IP stocks over the past decade -
and I'm glad we haven't lost the circuit courts yet - and I've
seen respectable decisions from the DC Circuit (an FTC
appeal where the FTC was overturned)to the CAFC where
the ITC and some federal trial courts were overturned.
As Bill Merritt said today, his company is doing very well
at the CAFC.
