I would say at this point both are a given. It is obvious they are lying about some stuff, they are definitely not open about progress, about what really happened at each delay, about what they actually have, about what they had months and years before, etc. And it is also quite obvious they are incompetent otherwise they would either have an actual product by now or would be running a better scam and wouldn't be in this much trouble.
