The Grundig consent judgment of only $10,250 is based on e.Digial's attorney fees and costs -- not infringement.

This amount is likely similar to the less than nuisance value settlement agreements from the other defendants as I have been expecting. We are not going to see the kind of settlements seen in the previous two group lawsuits.

It looks like Grundig did very little to even investigate the Markman ruling on '774 as their products almost certainly use RAM, which the '774 patent specifically excludes.

Thank you for posting it DISCHINO. It was my belief that the judgment amount would be given in the PACER filings.

Is it possible to get the entire text of this motion to approve a consent judgment?

This is Docket #21, which was filed on June 11, 2013 according to the Docket summary previously viewable at this link so it's two weeks old.

For some reason, the date in the cut and paste text is only partial.

I'd really like to see the actual document for the motion to approve a consent judgment that was filed in the Grundig case on 6/11/13 (Docket #21). I'd also like to see the actual document from the judge in response to it. Does anyone have a link to them?

The text quoted below is clearly not the language from the motion to the judge. It may be an attachment to the motion which was prepared (probably by Grundig) as a proposed settlement and was accepted by the parties who signed it. That would also explain the missing date in June.

The writing skills of the author are very poor. The grammar, improper use and non-use of capitalizations and plurals and poor punctuation are abysmal. English may not be the author's native language.

It appears that the author may have copied the part about the injunction from another document, probably one of e.Digital's filings, as it uses proper language.

The defendant (Grundig business system GmbH)

Admit that the asserted patents (737,108,170,774)

Are valid and have been infringed by the sale of the accused products within the united states identified as all Grundig digital voice recorder / dictation devices , including ,but no limited to , the Digta 7 Push , and the Digta 7 premium BT ;the Digta 4000 series of products including but not limited to the Digta 4015 and the Digta 4015 DS ; the Diginotice dictation series devices ; and the Digta 400 series dictation devices including but not limited to the Digta 405, the Digta 410 , the Digta x420, and the Digta 422 ; and the Diginotice dictation series devices.

Permanent Injunction shall issue against Grundig and Smoltz, enjoining each of them as well as their officers , agents , servants , employees , US distributors , attorneys and those in acting concert with them permanently from making , using or selling the accused products , and any derivation thereof which infringe any claim of the Asserted patents in the United States , until individually, each of the patent expires .The parties acknowledge that Grundig still manufacture and distribute analog voice recorder (Non – Accused Products).
