Let's just say this: The next time litigation-related legislation passes that does NOT have a grandfather clause or other phase-in timelines will be the first time.

WDDD and many other plaintiffs who have already filed suits and are in various stages of the legal process will be unfairly prejudiced if the rules were changed in mid-stream like this.

Although no one can guarantee anything when it comes to the knuckleheads up on the Hill, let's just say that the probability is absurdly high that any new legislation will only impact new cases filed subsequent to the enactment of such legislation.
