1. Lets ensure we understand what a USPTO ruling does and how it has any effect here. As someone who has researched this process, given the USPTO takes a much 'broader' view of patents than the courts it means that even while the USPTO may say there are issues, those issues tend to be very minimal in nature, they can essentially be the changing of a few words in the patent and have ZERO affect on the court ruling. This is something glossed over by most of the fear mongers.
2. MSFT applied to the USPTO for patents on the technology I believe in 2006? the USPTO rejected their patents and told them they were infringing on 420.
3. It will be very difficult albeit impossible for the USPTO to now say, oops those patents are 100% invalid and we messed up. Again, a simple logical consequence, fear mongers are avoiding dealing with.
4. Do the fear mongers really think they are smarter than the legal minds at MSFT, VRNG? Is this idea that the USPTO has a bearing or could impact new? is it novel? something they wouldn't think about prior to entering settlement discussions? LOL
5. Use some common sense folks. MSFT is settling, Google is running scared and just delaying, they have no work around and no options.
