You could be right but let me ask you this would you settle knowinfg the 420 patent has been rejected twice, vringo only has appeal with bpai, so i believe microsoft will wait for the uspto, even though they wilfully infringed there is no case against microsoft right now, judge will not let the 420 into court. We still have the 664 patent against them but it could be rejected also, microsoft waits. My opinon and i think we see them being served this week. Markman will not happen until upto makes a decision this works to microsoft favor right now that is why they havent settled they was not worried about this case with google, they was going to settle their case based on their negotiations with vringo not this case. Yea i have been wrong a lot been right some but this one i believe i am right.
