Very funny Amigo, I guess some of your facts may be a bit correct, but some are just plain assumptions.
Yes, Ceptazyme's lawyers motioned for dismissal for failing to pay the bills. We don't know if the client has the money to pay or if it could be intentionally giving up on the case due to some other reason. It might be part of one of those back room deals we, or I should say I, don't hear about except for in these lawsuits.
It's also stated that the damages are based in part on information it requires HEPI to provide. Much like the rest of the responses which state HEPI has yet to provide in the discovery process.
Apparent lies and misrepresentations by the managing partner of Ceptazyme? Where did you read that from? I see that HEPI couldn't complete its due diligence in time, Zus' members decided to take their trust money back, and so Bradley started up Ceptazyme. One member only wanted to participate at 50% of their previous level and Maggiore elected to fill the gap. That's where things fell apart on HEPI's end again-
"The September 2011 shipment was delayed because HEPI did not have the funds to pay the bottler for the production run. Mr. Robinson subsequently learned that HEPI spent part of Ceptazyme's down payment on other HEPI expenses rather than inventory. During this timeframe, there were multiple emails from HEPI promising to deliver the product."
Where did you read in Ceptazyme's response it misrepresented anything? It seems you might have a little inside knowledge there..
