I believe the countersuit is for a declaration from plantiff that PCFG does not owe the securities they filed suit for in the first place.

The plantiff requested the dismisal of their case as part of the settlement but the PCFG countersuit is still active until they get what they want or litigation begins.

Litigatiion is NOT likely IMO. However, we must wait for an 8k coming out about the same time as the Q1 based on the 60 day fuse on the settlement... 5/7/13

Let's hope VERT shows some mercy until then!
