The order dismissing the case provides an escape hatch/safety valve in case the settlement (whatever it is) falls through:
ORDERED THAT this matter be and hereby is dismissed without costs and with prejudice, subject to the right, upon good cause shown within sixty (60) days, to reopen the action if the settlement is not consummated.
Presumably, the parties themselves want the settlement, so the 60-day thing is a just-in-case measure, which in all likelihood will not get triggered. GL
