My guess that it is closer to the normal 1-2%.



The issue is very important and the Federal Circuit decision seems a perverse interpretation of the safe harbor provision.

If memory serves me there is also authority conflicts that could be resolved by Cert.

So I would put the chances higher - say 20-25%.

Of course, I do not have the background to really handicap this.

"There is no specific number of cases accepted each year. The Court typically hears between 60-75 oral arguments per year, and reviews approximately another 50-60 more cases on paper. The total represents a mere 1-2% of the cases submitted on appeal, due to limitations on the amount of work a nine-Justice Court can handle."



If I remember correctly one of the papers I linked to was about the fact that the USSC hears a meaningfully higher fraction of appeals coming regarding patents.
