You can name anyone as defendant in a suit. Often done to name as many as possible to cover your bases until actual discovery is made. Then you see what sticks.
I don't have the filing anymore (if you have link to pdf, great), yet as I remember reading previously the case resulted in the Gurbas being personally liable for the funds.
