Unfortunately, both the specifications and the subsequent re-exams only talk about barcodes - which has a standard patent definition.

If they go down the root of trying to prove an image is an index, the patents in suit will have expired or have days left. Considering, Global IP is footing the bill, they won't go for it since there is no revenue model for doing so. Global IP calls the shots on litigation, not NeoMedia.
