What your implying is that this would have been a day long court session. I dont know if the schedule is posted, but I think that if its true that the judge passed this on to a higher court, then I doubt he/she would have wasted time ordering this to happen.
It all makes sense.
Certainly would also validate the reason why MSX is quiet. They are waiting on a decision to report to the shareholders via PR.
