Technically you may be right. As I mentioned I have no expertise on the process. From a practical standpoint, however, I don't think it is reasonable to believe that the justice system could ever administer. Moreover, how one chooses to treat their body prior to being aware of their pregnancy is extremely difficult to legislate.
On the other hand, I find it interesting that those who would favor abortion even in the third trimester, still find it reasonable to punish mothers who deliver "crack babies".
