According to what has classically been defined as a day trade, that should only be considered a single one.
But of course the ultimate interpreter of the rules is your broker, so you should clarify with them before taking any action; I can't be held responsible if I'm wrong.
But again, that *should* only count as a single day trade.
That is perfectly legal, I'm on cash only restriction with etrade right now, I have made 2 buys and 4 sells in one day with no problem. You can sell as much as you want, it's the buying thats flagged for PDT. Still can't hurt to call though, I'm restricted for a $6 free riding violation, the trade fee put me over, a trade fee they refunded during a free trades promo! Bastards
