Fact/Fiction:

When you write the following noted below, it demonstrates you are fully aware that e-mails and calls you make to eDigital partners can have a 'pestering' effect and can be disruptive to the good relationships eDigital has with their partners. Whatever your self-serving motives to be seen as 'right', your admission that your pestering behavior can interfere with eDigital's conduct of their business, IMO, leaves you wide
open to litigation directed at you by both shareholders and the company for this conduct.

Notice how she takes a small bit of information and twists it.

"PortalPlayer is not going to be using e.Digital technology, e.Digital is one of the three companies that is authorized to design products with PortalPlayer technology."

"Are you saying that ..... PortalPlayer was going be using e.Digital's technology, is correct?"

"If so, can you provide proof of your interpretation of e.Digital's agreement with PortalPlayer that contradicts mine?"



The answer comes from EDIG Witch TorF downplays by calling it a "fluffed up PR".

-the only provision for use of e.Digital's technology is if e.Digital is engaged by an OEM to design a product with PortalPlayer's platform and integrates e.Digital technology or uses one of its reference designs.-

Her origional statement was--"PortalPlayer is not going to be using e.Digital technology."

The key point is that Portal player will not be licenseing EDIG technology, the customer that EDIG designs product through Portal Player will license the technology.

A good example of how TorF twists.

THe second paragraph:

People understand the relationship to be simply that e.Digital is approved to design products with your(PortalPlayer) technology.

Her main point was that PortalPlayer is not going to be using e.Digital technology.

Portal Player will not use EDIG in its base product but EDIG technology will be added to PortalPlayer designs and PortalPlayer will support to productize our solutions. eDigital would received compensation by working with the OEM customer who would pay them (EDIG) NRE and per unit royalties.


What is your point TorF ???????????????

Is she trying to say that PortalPlayer is not using EDIG in any way?

Are you saying that you both believe that the post I was responding to by BMPSKR, which interpreted the agreement to mean that PortalPlayer was going be using e.Digital's technology, is correct?
