Tinroad & GoSilver:
You deleted the following message of mine that was based upon a fact that both of you should already have known to be true (if you are aware of the nature of e.Digital's agreements):

PortalPlayer is not going to be using e.Digital technology, e.Digital is one of the three companies that is authorized to design products with PortalPlayer technology.
I believe you may misunderstand the nature of the relationship.
iPod will not be using e.Digital technology.
You claim that because I did not concurrently post proof that you believed it to be SPAM.
Are you both claiming that you believed my post to be false information and that what I stated was different that each of you claim is your understanding of what e.Digital's agreement with PortalPlayer is?
Are you saying that you both believe that the post I was responding to by BMPSKR, which interpreted the agreement to mean that PortalPlayer was going be using e.Digital's technology, is correct?
If so, can you provide proof of your interpretation of e.Digital's agreement with PortalPlayer that contradicts mine?
Your insistence on proof before you allow my statement to remain seems inconsistent with much of the hype you allow to be posted which is without any proof whatsoever. Therefore it seems that you are using a different standard to delete my posts than you uses for those who post things that promote EDIG stock.
As for proof, yes I do have it, but Matt is still restricting me to 3 posts a day, so I could not post it earlier. Here it is:
First of all read the press release, which announces that PortalPlayer has selected 3 "design partners" who are authorized to work with OEMs to design products with PortalPlayer technology:
http://www.portalplayer.com/news/partner_prog.htm
As you can read for yourself (and should already have known as moderators), this agreement does not have any provision for PortalPlayer to license any e.Digital technology.
Even if you read e.Digital's fluffed up PR you can see that the only provision for use of e.Digital's technology is if e.Digital is engaged by an OEM to design a product with PortalPlayer's platform and integrates e.Digital technology or uses one of its reference designs. In this case it would be the OEM, not PortalPlayer licensing EDIG technology. Nowhere does it provide for PortalPlayer to license e.Digital technology:
http://www.edig.com/news/releases/pr010903.html
These two press releases, which both of you should have had full knowlegde of, should have established the fact of what the PortalPlayer agreement entails. I should not have been required to post proof of a preestablished fact to avoid deletion of my post. Certainly my post was NOT spam, especially when one reviews the unproven promotional posts you allow to remain posted.
However, since you hold me to a higher standard, I found it necessary to pester an executive of PortalPlayer today to verify the understanding. Below is the e-mail I received followed by the e-mail I sent.
Have no worry, I will call anyone that I need to verify my posts if you are going to hold me to the higher standard that you seem to indicate. However, as you both know, e.Digital's partners have always been inududated with such requests and it does not always make for good relationships. Let me know if you are going to maintain this standard for me and I will let those I call know why I am having to pester the executives of e.Digital's partners. In fact, I will send them links to this board..
Here is the e-mail from PortalPlayer:
At present, the plan is your second paragraph below where we have approved three Design Partners that PortalPlayer will support to productize our solutions. eDigital would received compensation by working with the OEM customer who would pay them NRE and per unit royalties.
Hope this helps.
Michael

Subject: Design Partners - e.Digital
Mr. Maia:
Would you please clarify for me how these design partner agreements work? Many e.Digital investors believe that this means that PortalPlayer will be using e.Digital technology in future products and that even the iPod may someday include e.Digital's technology for which e.Digital would receive royalties.
Other people understand the relationship to be simply that e.Digital is approved to design products with your technology.
Under what circumstances would e.Digital receive royalties or licensing fees under this agreement?
I would certainly appreciate it if you would clarify the agreement.
Thank you,
xxxxx
You will probably want to write to Mr. Maia yourself since you will want confirmation.
If you can not prove that my post was false, then I ask you to restore it.
I also ask that you use the same standards of proof regarding my posts that you use for those who are pro-EDIG stock. If they post anything without including a concurrent link to prove that it is true, then you should also delete it.
Thank you.
