right.. well... i guess since they make mention of their intent to maximize value of current assets they are acknowledging their effort to gain a "a tender offer, or a partnership offering"
...at which would exclude them from the protection that the safe harbor provides.
they must not be able to legally include a safe harbor statement or something... as it maybe could be considered intent to mislead or something..
