That's a good point and why I am looking at every court document I can find. All I know is that at the first hearing the Court was not going to allow NOK to see the documents. We can assume that Nok was allowed to see the unsealed documents at a later point when the judge expanded the intervention and unvacated the MSJ orders. Once NOK had the MSJ orders they were probably free to use them in subsequent filed lawsuits until the reversal.

Got to go. I know LOOP and Whiz just posted on this subject. Maybe they can chime in.

Hookrider--Why do you believe that those documents referenced 3G info that was somehow leaked. As I previously posted, Nokia obtained the limited ability to use them in the 2G litigation in the UK. I have not seen any indication that those documents have been used in the Deleware litigation. Again, as I previously posted, Nokia may have stated in its papers with the Court that Judge Lynn had reinstated certain orders such as the partial summary judgment decision that impacted IDCC's 2G patents, but I do not believe that such ruling was put under any seal. And, I am sure that in whatever actions Nokia mentioned that reinstatement, IDCC will notify the Court of the Federal Circuit's reversal of that reinstatement.
