Ghors .. Thanks for your perspective. Do you or anyone else have any statistics on what percent of binding arbitration results are appealed, ignored, etc.? And in how many of those did the non-complying losing party eventually prevail?

Thanks,
Danny

Ghors

So do you think that a lobbying campaign would be a good idea?

"The laws are the province of George and his congress, not the courts. Courts don't write laws, governments write laws. Maybe he should spend less time protecting insurance and oil companies and more time protecting IP."

Ghors.

Never let it be said that Nokia's strategists are not pretty smart cookies. . . . . . . . . . to a point.

They're currently attacking on several fronts, but it all started with the first agreements, more than five years ago, IMO:

1. Let's sign an agreement with this pesky little twerp that provides for "starter" payments, followed by nothing for two years.

2. If we get caught by the agreement, we'll play the "out-wait 'em" card.

Keep eating-up huge chunks of time by demanding arbitration for 2G (2 years), followed by a lawsuit to invalidate 3G, which should be worth another couple of years. By then, most of their 2G patents will have expired, and the Delaware action should prevent them from signing 3G licenses.

3. If the ICC rules against us, take advantage of the law: Wait for 90 days and file an action to vacate, which will delay payment for several more months.

4. While all this is going on, throw a number of "press release turds" in Wall Street's punch bowl, designed to keep the price down, confuse, discourage, and mislead, until we come up with our next delaying tactic.

But, they underestimated Merritt and our legal guyz. They cut Nokia off at the pass by forcing an answer in the enforcement action in 10 days, versus taking possibly 6 months or more in a separate vacating action.

A small victory where time is concerned. But it's a start.

I don't really think I missed the whole point. I realize and am extremley thankful that we won the decision. I don't believe however that Nokia paying interest on the money they owe us should be considered much of a penalty. That is hardly a deterrent for future delays and attempts to not pay us in the future. They have been using our money for their own personal use without our permission and we have had to invest many years and more dollars to try and collect what is rightfully ours.
I definitely do realize that we have fought many wars and lost many lives to maintain our Democratic society and what it stands for. I also realize that our court system and its many laws and procedures have been formulated to protect the innocent and provide due process. Unfortunately the predators in business and general society are much to often able to use the loopholes and intricaties of the system to escape true justice. We just have to mention O.J. or Robert Blake or the latest scumbag sex offender to show that justice is certainly not always done in our court system. It is definitely structured to provide a fair and proper determination but it does not always work and often times an innocent person also is found guilty. Of course this is a different type of legal scenario than we are dealing with but the fact remains, loopholes and less than ethical tactics frequently work in favor of the offender.
Yes we certainly do have a problem with our intellectual property laws and until that is changed we are in trouble. Lets not blame the current weakness of those laws on good old George. Everyone before him, and that includes good old Bill Lewinsky, could have also participated in making those changes if he were not spending so much time sitting at his desk with his fly open. He was too preoccupied to worry about insurance and oil companies.
The interest on money owed is all fine but is not a deterrent to further delays on payment. If they put that money in the bank they were receiving our interest.
I definitely believe in "staying the course" but I also believe in more severe punishment. Thus far nothing has happened to convince Nokia and others that it is to their benefit to pay up early.
