Dooger: My apology. My post and the following wasn't and isn't meant to be an affront to you personally or your opinions. You have your right to them and I applaude your right to express them. I merely wanted to point certain things out about the importance of this award and to show that it is the laws passed by our Congress and not the legal system per se which is causing our grief.

I certainly agree that evil minded persons or corporations can abuse Due Process by using a good system to stall the final outcome. They are able to stall because there are so many cases that the system is overwhelmed. Hence, someone with money and who is guilty is able to work the overload to their advantage. It is the innocent, with no money, who get hurt. Thank goodness IDCC has the money to fight.

The penalties are pretty much in place, but you can't use them until you win. Even if you make them more severe, the problem is NOK has the absolute right to defend themselves just as we have the right to defend ourselves in the Federal case. Federal may be just as mad as we are about our demanding a fair trial and using the law, but we have the right and they have to live with it.

I too am sick of NOK and want IDCC to win, but I am not willing as an attorney to subvert the system. I will defend it to my dying breath. On the otherhand, as an IDCC long and wanting to make money, I am impatient and wondering if this will ever end.

One last thought. Let's be thankful our targets are companies from free societies. I have a friend, who was very, very high up in a company we need to sign who was scared to death of the chinese. His company was spending billions in China and they weren't sure they were going to get paid and had no idea how they were going to force the Chinese government to do anything to protect foreign IP.
