Dooger: You and Davids and other who attack the legal system miss the point in my opinion. We won and there is a penalty. It's called interest (probably compounding daily)and a potential injunction. AND there may be more. (read Loops, Olddogs and others posts on this subject) The legal system worked and it will continue to work. If it is slow, it is slow. That's called a democratic society where each party is etitled to due process. We fought and died in many wars for this process. Remember what last weekend was all about and Remember the alternative is summary execution. Do we really want Courts catering only to the strong? (NOK) IDCC has received due process of law and again WE PREVAILED. If there is a problem it's that our Intellectual Property laws aren't strong enough to protect small companies from this type of preditory act once they prevail. The laws are the province of George and his congress, not the courts. Courts don't write laws, governments write laws. Maybe he should spend less time protecting insurance and oil companies and more time protecting IP.

Further, the interest alone on this award is probably 20 million dollars per year by this point. That's about 1/7 of our gross income and is not insubstantial. Samsung is also paying interest of about 2.5 million per year.

I believe that all here must understand and take hear that IDCC WON. A neutral arbitrator ruled in our behalf, on the world stage, in the face of hugh power and money. Further, if you are a lawyer and work in this system, you know that at least 85% of all appeals are lost. AND any appeal (vacatur in an arb) whereby the burden of proof is to virtually show gross wrongdoing or stupidity by the panel probably has a higher loss ratio.

As the generals say, "stay the course". The trial was the hard part, this appeal process will be over before you know it and the odds are now greatly in our favor. In the meantime, we must be patient and let the system continue to work. Rome wasn't built in a day.
