Hey Scar---You are absolutely correct. There is no way Chevron would appeal this to the US Supreme Court. They could appeal the three panel decision to the entire 11 member Circuit Court---but this is a discretionary appeal on the part of the Court---and the BS that has transpired in this case would make such an appeal an absolute nullity--no chance the full panel would grant such an appeal. What Chevron needs to do and WILL do is present a structured settlement, maybe buy several annuities with funds paid out over a period of many years. They could put up 6,7,8,9 billion over time and easily make it look like the 18 BIL verdict. It will look like Chevron did its civic duty and the 30,000 plaintiffs will be taken care of, get the best medical care, and the environment will be rehabilitated. FIRST ORDER OF BUSINESS---Establish current health care and then annuities for the immediate and future care of those physically/medically affected by this horrifying tragedy. Health care in perpetuity(or for 2 generations). Best PR they could buy. SECOND ORDER OF BUSINESS----Pledge to rehabilitate the environment to a physical state currently within capailities of modern science and with VERY LARGE ORDERS OF MOP to establish the current capabilities. AN ARBITRATOR/MAGISTRATE to be appointed to determine medical needs of the 30,000 plaintiffs that have actual medical needs related to this huge OIL F/U. Also same structure for oil remediation--what can and must be done, including the total tonnnage of MOP needed to clean up this unbelievable mess. This can and WILL be set up very shortly as the medical/oil remediation plan. It will be put together in VERY SHORT ORDER. Chevron has no luxuries of time here. MOP needs to be at the forefront IMMEDIATELY through our contacts/product reps. This will happen FAST. There is lots of hidden sh^t that Chevron WILL KEEP THAT WAY. And to MOPN-UP---NO, there are no tax liabilities for Chevron re the issues discussed above. They will structure it all---Put some cash up front and probably buy annuities for the rest.
