Your thoughts on this FOB thread. Now that we have some proof that the courts will protect MNTA's novelty esp if no new proxy signature(and testing) is done by successor generic.
Is it reasonable to make an inference like
"On the other hand if you "choose" cell host line based on certain parameters(to prove sameness) you will likely infringe on MNTA's patent at least for NEXT 20 years-2031(This patent is fresh out of the oven.filed in October 2011) "
choosing/developing/maintaining cell host line - is this a development or commercial manufacturing activity?!?! i would envision you may need to test the host line for certain parameters from time to time so it is within tolerance of your identified parameters-hence part of commercial manufacturing
