I'd say they do have it nailed down, and I should point out (I'm not a lawyer but my wife is a litigator and talks about her cases) you can neither depose nor initiate discovery until you have filed.
I buy enough white box systems to have some contacts in the industry and was told about the solectron extortion (and posted about it on SI) before anyone outside of the immediate parties had heard about it.
I think it's fair to say
1)that Intel was rather blatantly violating the law by interfering in 3rd party contracts
2)that Intel did a poor job of covering up their crimes
3)Intel is going to have to pay quite a bit of money in damages
