Failure to comply with a Court Order could result in a finding of contempt or the imposition of a fine on the defendants. More important, it would presumably weaken the defendants’ chances of prevailing in a trial, should there be one.

What is the likely scenario if / when Momenta complains and the court agrees that the items were not provided as requested?

My guess is that the court would continue the hearing on the PI, extend the term of the TRO and again order the production of the disputed items.

Sanctions are a plausible but only after the court is certain of the evasion of the orders.
