The nowhere part I take to mean that judging from what they have been able to accomplish so far. Looking at what Ampha is currently selling, it seems a stretch to me that Ampha could have satisfy the FDA's requirements without cheating or infringing on Mnta IP.
When I worked for HP (20yrs) now and then they put me on interview committees to select new hires for the r&d lab I worked in. One rule HR taught me was that "past performance is very indicative of the future".
Based on that principle, it seems very unlikely to me Ampha could have been successful on their own. That they filed first is irrelevant. Lovenox is a huge mkt, they were probably attracted to it for the profits.
Hell, I have always wanted to work for Google, does that mean if I applied early enough, I should get hired ?
