Sanofi manufactures enox without violating any of MNTA's patents, so clearly it is possible to do so.

Of course, I should have said "generic enox."

Again, as a layperson, it seems to me that MNTA has been saying all along that to manufacture the generic one must violate their patents.

Yes, but Momenta's claim isn't about manufacturing per se - it is about meeting FDA standards. Momenta's claim is that generics are held to tougher standards or at least different standards for testing. And it is in meeting these standards that a generic manufacturer would have to violate mnta's patents.
