Churak- good point. It totally negates any argument that relies upon counting up the NNS. That is a moot issue. CMKX really new that, that is why they didn't bring up the NNS issue to begin with and that is why the Division, supported by the judge, moved to not allow any talk about the NNS.

You can bring up the NNS issue, but it would be in a different case and from what I have seen, most if not all of those cases were denied.

Now either Frizzell knows this, and is milking the shareholders, or like he stated up front, he is not a securities attorney and is learning as he goes, at the shareholders expense. Either way he is milking the shareholders.

Churak - You are very much on point about the issue of reporting and share issuance.

What goes on in the stock market and the whole world outside the issuance of shares by the company and registration with the transfer agent, is beyond the scope of an audit and therefore has no bearing on the f\s and therefore the filings. The Judge picked up on this it appears. Very bad news for CMKX IMHO.


Now, could you please explain this to "AbadCPA" over on RB?
