If the ITC approves an investigation, it seems likely the value of the portfolio in all G's gets a limited validation.
It may blunt unwelcome news from CAFC should that happen. I wonder whether the newly claimed patents include those which were sought to confirm the meaning of the patents in the CAFC case.
If we do get a remand, I don't see consolidation as likely because so much water has flowed over the dam already in the CAFC case. There wasn't a claim from anyone that a retrial was needed, so delaying final disposition for a trial of the new issues in the new case seems unlikely to me.
The timing of these lawsuits is probably influenced by the Evercore/Barclays team. Standing alone, IDCC has tried to be as friendly as they can while being tough. Now the gloves are off. The sooner arguments against Nokia, ZTE, etc. are validated in any way, the sooner they become more valuable to Apple, Google, etc. This will definitely broaden the playing field, and hopefully keep the process moving quickly.
