A hypothetical short postion has NOTHING to do with CMKX's failure to file timely (or at all). That's what the judge is interested in, and that's all she's interested in.

Jimmy, June 18th is my birthday, and my son Matthew's birthday. I owned CMKX way before you did back when the 10 to 1 or 8 to 1 FS got screwed up when the stock was CMKI. Brokers delivered shares to people's accounts early when the stock was trading at .08 cents or so. It tanked to .01d and then bounced back to .08ish.

CMKX revoked on my birthday, on my son's birthday.

Almost makes we want to buy a few shares.

I can't wait to buy that CD too...
