If true, I would not expect MNTA to go into such length and detail when discussing the supply constraint like they do.

To the contrary, the gratuitous detail regarding Lovenox supply on MNTA’s CC’s is a case of protesting too much in the Shakespearian sense. These comments are intended to be heard by whoever at SNY has the job of listening to MNTA’s CC’s or reading the transcripts. They come close to—but do not attain—the threshold for illegal price collusion and have certainly been drafted by MNTA’s and NVS’ lawyers, which is why they stand out from the other CC comments like a sore thumb.
