Comparing apples to apples, if IBM was in a lawsuit with Intel at that time, maybe they would have bought them out.
IMHO, I say the buyout has to be a consideration on IBM's table, due to the current lawsuit and past mistakes. And the sooner they do it, the less it's going to cost them.
