NY DEC determines WHEN it ends!

ANYTIME AFTER the 15 day period for filing any "comments" ends (6-9-2011)... NY DEC can issue the permits at its discretion!

So June 9th is when the 90 day public comment period begins? Who determines when that ends and why?



The public comment period is not 90 days; 15 days is all that is required. The DEC is calling the shots.

(6) The deadline for submission of written comments on the application, including any request for a public hearing. The minimum time frames for review and comment are as follows:

(i) applications supported by a SEQR negative declaration, not less than 15 days after the date of publication unless otherwise specified in this paragraph; . . .

"Publication" is expected on May 25. Fifteen days from then is June 9. The DEC has given JBI the requisite "SEQR negative declaration." Thus the assertion on the DEC's website that: "Written Comments Due: 06/09/2011."
