I understand. I agree with your assessment of what they will get for their $25. I think CMKX counsel is going to try and blame it on the people involved prior to 2003 but I don't think that is going to fly.
It's the share count that he is getting that is the most important defense CMKX can have. When Frisby shows up with his count whether it is suspect or not, the judge can't ignore it nor the principal on which it was founded .. to show that there is a THIRD group at the hearing who trusts neither of the other 2 parties. No way the registration gets revoked. And Frisby and Martin deserve full credit for that. There is no need to dwell on Shorty at all .. RIGHT NOW. That is coming. Count on it.
