Retflyr- No reason for the SEC to pull out. The govt. doesn't start and then pull out. They make sure they have a case before going in. If NNS is an issue, then that will be decided in a different court. The reason CMKX originally gave for de-listing themselves was the shareholder count was under 300, not due to any NNS problem which prevented them from filing. They have never stated that they couldn't file due to NNS issues until the SEC started to investigate USCA and now them. This case is about filing requirements.
They've probably been investigating CMKX since last summer. Definitely since last fall. Apparently they've taken quite a few depositions, and they've requested a lot of documents. And they did all that before they set the administrative hearing in motion.
