What would be the point?
As soon as Iron Bob announces that there is a trillion-share naked short position in the stock, the judge will say, "Oh, never mind then, case dismissed! Let's start extraditing those nasty old hedge fund managers from Fiji - I've got the forms right here, if we all fill in a few each, it won't take long...."
Excellent observation, Janice. I guess they are going to throw themselves on the mercy of the court with some kind of "dog ate my filings" pleadings.
Which will likely not be granted.
Actually, I will be surprised if there is a hearing. My bet would be for a settlement. In looking at the relative line-ups of witnesses and exhibits by CMKX and the SEC, it appears that the company is bringing a hat-pin to a gunfight.
