I would have thought a contract would stipulate that they must demonstrate that they have the capacity to fulfill it.

I would tend to agree. CPOW management would be nuts to sign a lease like this without having the funds in sight. Whether or not the JV goes through to build a processing plant, Chongquin still needs cooking oil and CPOW now has THREE facilities to produce it - Saskatchewan, Montana and Alabama.
