It looks to me that old Slurps rantings are fairly close to the actual chain of events that initiated the SEC investigation of CMKX. The only chance that CMKX can survive this court date is the fact that they did beat the SEC to the punch when they were first to address the filing mistake concerning the number of shareholders. It's a long shot but the judge could possibly allow them some room with that issue.
