If that is the case why did they go through the trouble of getting orphan status less than 2 months ago…?

Applying for and getting an FDA Orphan Drug designation involves minimal effort (provided that the addressable market is less than 200,000 patients).

Is pursuing orphan drug status required in the contract?

I'm sure ABT followed the contract (as they interpreted it). They may just want out now.

It does seem like they expect approval, based on how they are acting.


It seems to me either they want out because they think the market isn't lucrative enough. Or they want to strong-arm a better deal.

I don't know which case is more likely right.
