You should be able to look to the company. The SEC says that THEY have concerns about certain information that the company has provided.....but YOU don't have to. So, when you ask who "we" should be looking to, it's a matter of individual choice.
That said, I believe that the use of the poison symbol and the "Caveat Emptor" label would cause a reasonable person to pause before they relied on the information disseminated by a company with those designations.
