I will suggest too that if the DEC is unwilling to provide a permit JBII will simple move elsewhere - Canada & Florida being at the top of the list. CRA test results are incredible.

lol..no offense taken...Oct 16th was when I first heard about the solid waste permit issue from Donna in the air dept...from there she referred me to Effrat Forggette in the region 9 SW dept who basically said this was her first rodeo with this type of thing and it was going to Albany to be looked at. I then talked with Ted Williams assist Kathy, dont remember the last name..She then explained the BUD process to me around the first of Nov.. i also talked with her after veterans day and she told me most likely they would require a SW permit. I spoke with Sitzman region 9 air dept the week prior to thanksgiving and he told it was going to be either a BUD or a Solid waste permit they would need and the air permit would not be issued until the SW issue was sorted out.. he said they dont issue one permit at a time ...always it was a minimum of 8 weeks to get through the SW application process..I talked with Ted Williams SW dept Albany, finally for the 1st time in albany the friday after Thanksgiving and he told me that it was his recommendation to Mark Hans in region 9 SW dept, that a SW permit be required..8 weeks to process at the fastest..no one had mentioned to me up to this point anything about issuing the air permit separately and allowing them to go into commercial production while a SW application was processed.

It wasn't until I called David Denk on Thursday who's number I was given over a month ago by Kathy in albany, that I learned that region 9 was seriously considering doing something much different from the norm and definitely way different from what I had been told up to that point.

So, if the DEC does what Denk stated they most likely were going to do, and that is, issue the air permit with the stipulation that the SW app be filed by a certain date, JBI will be going into full production very soon. Denk said they were very close to issuing the air permit. I asked if it could be within 7 days? Denk said yes.
