Denk said that the air application has been somewhat of a moving target as he said Hal Pierce made some changes to it even today.
Denk said that JBI has not exactly been forthwith with the info required for both the air permit and the info they were looking for while making the BUD determination and this has taken longer than maybe needed.
he did however say they thought the entire op was very cool and that the DEC was definitely interested in seeing new industries thrive . he said in no way have they been trying to hold this up..delay rests with JBI.
But here ya go..the air permit could be ready within 7 days or so and they are seriously thinking of issuing it with the clause that they get busy filing for the solid waste permit within a specified tome period..they realize this has been an incredible saga for JBI and shareholders.
So all this means, they could be in full operation very very soon.
I got the impression from Denk that will be the way it plays out
Here is a corroboration from the same day:

Thanks LTG. Just jumping in here to corroborate your report. I was told basically the same thing today. David Denk told me that the air permit will be issued very soon. He also said the department determined that a solid waste permit would be required, and no BUD would be granted. I asked whether JBI would be able to commence operations under the air permit, before the solid waste permit is granted. He said that they are going to work with JBI on that, and that they would like to see that happen. He also said that the details are not entirely clear at this point.
Here is a corroboration that Denk says air permit should be submitted next week, "if not sooner".

ok. my very first post. i'm a long and a believer in jbii. yes,i did go to the agm and yes, i went to the plant.i've met and spoke with jb and came away very impressed. as with all the other longs here, i'm sure we love the concept and where we beleive this is going. of course, it's been the timeline that's been the major deterrent. that being said, i beleive we are getting closer by the day to seeing our little baby grow and expand to be the company we all bought into and for the potential we all feel it has.
the reason why i'm posting is like many on here, i was getting tired of all the "he said, she said" crap, so i took it upon myself to call david denk. he was about to leave because there was a snow storm and everyone was in a hurry to get out. he did give me a couple of minutes though. as far as the air permit goes, he said it should be submitted next week "if not sooner". guess what? that COULD be tomorrow. if not, then nothing wrong with next week. i'm glad i heard it straight from the horses mouth. he did also say that the sw permit was required but that's not a big deal.he said all the engineers were buying into the concept and were very impressed. i for one was very encouraged after hanging up.i'd like to call him back tomorrow ( he left for the day) to see if production can start with air permit alone while waiting for sw permit. not sure of that. being that this is my first post, you can either beleive me or think its' all poppycock. i'm very glad i spoke to him and i'd encourage anyone else who has any doubts regarding the permits to call for yourselves. the way i look at it, i've had my money in jbii for well over a year now. am i sick that i didn't sell when it went to $ 7? ya got a bucket? of course i was sick. this is typical rome wasn't built in a day thing. bottom line. i've waited this long; if i have to wait a couple of months for sw permit and a couple of more snags down the road............ bottom line is i think jbi/p2o is going to make us longs very very happy ( not to mention rich) in the not too distant future. good luck to all the longs.( particularly zar,raw and brig) who got me into this diamond in the rough. happy holidays all.
