Nokia was not a "party" to be given consideration at the time that InterDigital and Ericsson/SNE settled their differences. Nokia had CONTRACTUAL obligations to InterDigital which were NOT directly represented in the legal proceedings of Ericsson vs InterDigital. That means they had no basis of recourse under rule 60b, and not under Bancorp without reaching past prior interpretations from what this observer can figure out. IMO it was a SMART move(as 2112 pointed out), and it is playing out just like we would want it to. Tip of the hat to Harry, Howard, and F&J for some more good work.
