Is there any way we can get an appeal and go all the way back to where Diac got a huge portion of the patents by making a phone call (that accomplished absolutly nothing) to the patent office.

So that we can get back 100% of the patents and see him in jail!

Wow, what delusion. Listen, Daic is never going to settle. Why? Because he will "reap the most benefit" when he wins the state case. He'll get the whole patent.

CLYW has in fact defaulted. But CLYW cannot prove Daic kept them from raising money. The BOD turned down the Acacia deal. Daic has never been on the BOD. Sure his wife was, but how are you going to PROVE he made her vote no. And even if you could, it takes more than 1 vote to turn it down so he didn't all by himself cause anything. Sorry, CLYW is not going to win the case. If you read Daic's amended filing, he says that very thing on every charge - CLYW has no proof. CLYW just threw everything at him in hopes something might stick.

So when Daic wins the case, he will get the whole patent and game over. TM knows at least that the patent is in question, so they'll never do a deal with CLYW. They'll wait to see how the case comes out. That's why they agreed to the stay - not to negotiate a deal, but to stall.

As more and more time goes by, Calypso is able to approach investment bankers etc. to line up funding to take out Daic at $110 million. Think of the appeals etc Calypso can make to stall this thing out. All Calypso needs is about five firms willing to put in $25 million a piece to take out Daic (Heck with a loan from Microsoft alone that shouldn't be too hard). There have to be enough firms out there with this much cash laying around that want to get in on the action.

Dave it's time to contact Google, Microsoft and the big boys to see if they want in on the action. Maybe that's what the Tmob talks are about. A partnership with Calypso ends their law suit, legitimizes the patent, creates opportunities with the other cell phone companies and gets rid of Daic. With the upfront money, no negotiation is needed with Daic. Tmob shares in the future profits, it doesn't cost them anything other than upfront money easily reimbursed from new licensing deals and LIFE IS GOOD.

Daic's time for settlement is running out otherwise he ends up with chump change.
