Without all of the "facts" it is difficult, make that impossible to answer. My concern is a ticking clock which may have already expired if he is correct. If he is not correct, then it does not matter. If I were to raise a defense against IDCC for not filing a malpractice case timely, I would use this board to show that they new or SHOULD HAVE KNOWN. Again I do not even know the statute of limitations for malpractice in the jurisdiction where one would be brought. In my state it is two years from the knew or should have known date.
