OSO and Loop--It is my understanding that under the law that created the Federal Circuit Court of Appeals, all appeals of any judgments from district courts where jurisdiction is based on patent infringement claims goes to the federal circuit. Thus, appeals of district court decisions are not divided up based on the nature of the appeal. As jurisdiction in the Ericy/IDCC case was based on patent infringment (or the claimed lack thereof by Ericy), any appeal would go to the federal circuit.
