I said Cicuit Court when i meant Federal Circuit. The Federal Circuit has jurisdiction over patent matters. It seems to me that the issue here is really not a patent issue, but, is rather a procedural issue. It would seem to me that the 6th Circuit (procedural question) could return a result much quicker than the Federal Circuit (patent issue) will.
