How long will it take for DEC to process the permit?

This post was the genesis of the Agilyx which morphed into an Agri-Plas discussion last night, so I am responding here in an attempt to provide clarity to your assertion as well as some of the evolved miss-characterized points:

The following is based on DD to include phone conversations with representatives at both Agilyx and Agri-Plas:

Agilyx is permitted. It operates 5 days a week 24 hours per day. It sells what it produces.

Agri-Plas was a test facility and the test processing equipment was removed September. It is permitted and it sold its product. It anticipates beginning to receive the new processing equipment in February, 2011 and to (re)commence expanded operations within 6 months.

There was a lot more interesting things brought up in both conversations, but this at least should clarify that:

--JBI will not be the first permitted plastic to fuel processor in North America.
--Agilyx is indeed still producing and selling product.
--Agri-Plas is anticipating an upgrade beginning February 2011.

Hope this clears up some points of contention.
