why yes jerry .. it certainly is particularly since i posted *it* :)
and i'm not asking for anyone to agree or disagree with my take because until fins are audited we have no way of knowing specifically who holds what beyond which was known after the last form D was filed and what mgmt has publicly stated a few times over that no co. insiders have sold one share and courtesy of the last pr that restrictive legends are still on glenn and jd's stock :)
however re: the 60M (57k) last *known* PP anyone can contact mgmt and ask who was the recipient of those restricted shares ~ they went to randy and gary from so. candle who gave their permission for one and all to know
if the implication is that they were selling their shares and re-buying .. i'll disagree
i look forward to seeing audited fins out on expo/exph showing which co. *insiders* hold
imo that is part and parcel of the full transparency that is being sought .. but until the $$$ is there for that audit .. i suspect it's not their highest priority perhaps because mgmt knows exactly who holds their shares and it's quite clear based on the pr out on 9/15 that the allocation of funds goes first to keeping their doors *open* and products shipped out the door
imo one of the 2 men from so. candle now holds well over the 5 percent (and 10 percent) threshold and will be shown with an audit (my total for him is 100M non restricted .. 30M known restricted and the *possibility* of the last 100M issued on 7/21/2010)
again .. it's very clear that a handful of folks hold the bulk of the shares .. and while i feel for those who've sold at a loss and plan to rebuy at a lower pps .. that is a strategy some undertake
others like myself continue to add shares when the pps is *taken* to where it is advantageous to my CB/cost basis
like i said i'm very familiar with this *pattern* but it took until last september to *understand* why it was in place and why it was being done ;-)
oh and i do agree with this sentiment expressed in your post jerry ..

bottom line for me is simple .. while disappointed that fins/forms weren't out for the SM (and make no mistake if i were ceo i would have canceled until events covering ETC new ceo ~ fins and forms were out) .. that call is reserved for those folks who know all there is to know re: expo not just bits and pieces we the shareholders put together
and i laugh at the notion anyone else besides mgmt will ever know the full picture even with fins and forms filed that is a fantasy .. only those with working knowledge of ' every tangent has a clue
but i deduce that the co. came this close to shutting their doors and i give the reasons why in my post that you responded to
that is called risk/reward and in the OTC *particularly with few eyeballs watching* it's why ceo's can be called liars and co.s can be called scams .. but the very *hint* that there may be a discrepancy of shares *shorted* on exph riles

ETC .. first retailer known within 2 weeks of the SM (eom)
follow thru by mgmt on shareholders' update section with what has shipped .. which won't violate NDA's
fy 2010 .. q1 and q2 uploaded to the trusty site aka pink sheets
form 3s filed for mgmt and bod (form 4s and last form D if applicable)
new ceo (name/background/comp pkg)
while known for my patience .. it's not infinite .. based on the interaction of those folks who ACTUALLY ATTENDED THE MEETING AND MY TRUST IN THEIR OBSERVATIONS .. i will be holding my EXPH shares into jan 2011 .. if that is considered a carrot .. so be it

i personally have no clue who the new ceo is .. folks who've asked my opinion on kendrick .. have been met with my honest observations it's quite clear he's got well established connections with both home depot and lowes (or as mgmt refers to them orange and blue) without knowing his business bio .. i have no knowledge of his pubco experience which is what i was seeking for this level of expo's transition
if it is he .. i would hope he's a real quick study since i don't see the toxic cesspool aka the OTC being *fumigated* anytime soon
lastly .. while mgmt has access to a copy of the trades done out of a long's account last monday (6M with the first *sell* at .0024) the sec has yet to receive a copy of this since i'm still playing telephone tag with them .. (as i am with finra re: exph's ftds)
anyone who *actually* calls the sec and/or finra and *connects* the very first call .. is from my experience ~ a rare event
it can literally take a week depending on who within the *system* is being contacted
not exactly *user* friendly .. that said i'm persistent and will follow thru since it was quite clear to me what monday's *efforts* were all about
and the SOR of those trades has no problem with that info being known by sec/enforcement (btw .. contrary to what some may believe i was not the owner of those 6M shares) all of my exph shares are held via CASH accounts (and yes my kids hold shares too)
